Haul Alot Logistics (“Haul Alot”, “us”, “we”, or “our”) operates this website, including the webpages and services delivered through the domain haulalot.com (collectively, the “Site”). At Haul Alot, we understand your concerns about privacy and are committed to protecting it through our compliance with this notice.

This Privacy Notice describes the types of information we may collect from users (“users” or “you”) or that users may voluntarily provide to us when they use the Site and in email, text and other electronic messages between the users and the Site, and our practices for collecting, using, maintaining, protecting and disclosing that information. This Privacy Notice does not apply to: (i) information collected by offline or through any other means, including any other website operated by or any third party (including our affiliates and subsidiaries); or (ii) any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the Site. If you do not agree with our policies and practices, you may not use or access the Site. You are expected to carefully review this Privacy Notice from time to time so you are aware of any changes. However, if we make material changes to this Privacy Notice, we will notify you either through the email address you have provided us or by means of a prominent notice on the Site before the change becomes effective. By using the Site, you agree to be bound by any such changes and to ’ collection and sharing of your personally identifiable information according to the terms of the then current Privacy Notice.

Information We Collect

We collect information you share through the Site. We may collect personally identifiable information, such as your name, postal address, email address, phone number or any other identifier by which you may be contacted online or offline (“PII”) only when you have voluntarily provided such PII to use (e.g., through registration, contact inquiries, etc.). As a general rule, we use PII only for the purpose for which you have divulged the data to us, such as to answer your inquiries or to grant you access to password protected portions of the Site.

We may also collect information concerning you, including, but not limited to, the kind of product or service you are seeking from.

We may use Google Analytics or other similar technologies (the “Analytics Technologies”) to collect and process certain information about you and your use of the Site. The information collected by the Analytics Technologies is statistical data and does not include PII, and we do not maintain it or associate it with PII we collect in other ways or receive from third parties. Our web server and/or Google Analytics may also collect Internet protocol addresses (the Internet address of a computer) to track a user’s session while the user remains anonymous. We analyze this data for certain trends in statistics, such as which parts of the Site users are visiting and how long they spend there.

We may also use “cookies,” which are small files stored on your computer’s hard drive that are used to store and track personal information. Cookies are used to remind us of who you are in order to deliver you better service.

Do Not Track Policy. HAUL ALOT LOGISTICS will endeavor in each case to enter into a written agreement with the carriers with whom it arranges to haul Customer’s freight, which, among other things, will define the roles and terms that HAUL ALOT LOGISTICS and such carrier will undertake with respect to such freight. Customer may request that HAUL ALOT LOGISTICS provides Customer with a copy the form agreement that HAUL ALOT LOGISTICS typically enters into with carriers, although Customer must recognize that the terms of HAUL ALOT LOGISTICS’s agreements with carriers may vary from time-to-time.

We may also use these automatic data collection technologies to collect information about your online activities over time and across third-party websites or other online services (“Behavioral Tracking”). “Do Not Track” is a proposed standard that is currently under development. As it is not yet finalized, we adhere to the standards set out in this Privacy Notice and we do not currently respond to “Do Not Track” signals on the Site or on third-party websites or online services where we may collect information. The information we collect automatically is statistical data and does not include PII, and we do not maintain it or associate it with PII we collect in other ways or receive from third parties.

2.5 If HAUL ALOT LOGISTICS’s name is inadvertently or otherwise listed on shipping document as the carrier or in any capacity, other than as a “third-party bill to” party or as a broker, such listing shall be deemed to be for convenience only and shall not change, alter, modify or be construed to change or modify HAUL ALOT LOGISTICS’s role as an interstate freight broker only respect to any load of freight.

Some content or applications, including advertisements, on the Site are served by third-parties, including advertisers, ad networks and servers, content providers and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use the Site. The information they collect may be associated with your PII or they may collect information, including PII, about your online activities over time and across different websites and other online services. They may use this information to provide you with targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about targeted content, you should contact the responsible party directly. We may use your PII to contact you with newsletters, marketing or promotional materials and other information that is pertinent to the use of the Site. By using the Site, you are consenting to this.

What Information is Shared and With Whom

We do not rent or sell your PII to outside marketers. We may share your information (as described in this Privacy Notice) with its affiliates, subsidiaries, or divisions and with their respective officers, directors, employees, accountants, attorneys, and agents, or with ’ business partners. In certain circumstances, we may share data with vendors to help us provide you with products and/or services that you requested from us, perform statistical analysis, send you email or postal mail, or provide customer support. All such third parties are required to maintain the confidentiality of your information and are prohibited from using your PII except to provide services to or as required by law.

We may provide information to regulatory authorities and law enforcement officials in accordance with applicable law or when we otherwise believe in good faith that the law requires it. There may be instances when we may access or disclose your information in order to protect or defend the legal rights or property of Haul Alot Logistics and its affiliated companies or their employees and agents, to protect the safety and security of users, and to protect against fraud.

Haul Alot Logistics may sell, transfer or otherwise share some or all of its assets in connection with a merger, reorganization or sale of assets, or in the event of bankruptcy, without your permission. In such an event, PII may be one of the assets transferred.

The Site is hosted by Namhost (“Namhost”), and therefore, Namhost may have access to your PII. We do not control how Namhost may use your PII. The Site is developed and supported by third-party vendors, who may in the course of performing their services for us have access to your PII. We contractually require such vendors to maintain the confidentiality of your PII and keep your PII secure. We do not allow such vendors to use or share your PII for any purpose other than in performing services for us.

We have implemented measures designed to secure your PII from accidental loss and from unauthorized access, use, alteration and disclosure. All information you provide to us is stored on secure servers behind firewalls.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your PII, we cannot guarantee the security of your PII transmitted through the Site. Any transmission of PII is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

This Privacy Notice is applicable only to the Site and does not apply to any third-party websites or to other companies or persons that may access the Site, with or without our permission. Protecting Children

Haul Alot Logistics only collects PII for the purposes of providing you with products and/or services that you requested from us and the support of those products and/or services. Haul Alot Logistics will use commercially reasonable efforts to ensure that PII we may be using or disclosing is accurate and complete. If you demonstrate that your information is inaccurate or incomplete, the information will be amended as appropriate. We will use commercially reasonable efforts to respond to any request and update your PII, if necessary.

Governing Law

This Privacy Notice and any disputes related thereto shall be governed by and construed in accordance with the laws of the Republic of Namibia, exclusive of its choice of law rules.

Section 9 — Miscellaneous.

9.1 Governing Law/Jurisdiction: Negotiations for the offering, tendering and/or referral of freight to HAUL ALOT LOGISTICS are be deemed to have been conducted within the Republic of Namibia. Accordingly, except to the extent (if any) that they are preempted by law, the laws of the Republic of Namibia shall govern the construction and interpretation of these Terms and Conditions and the dealings of Customer with HAUL ALOT LOGISTICS. Customer expressly submits to the jurisdiction of the Courts of the Republic of Namibia and agrees that jurisdiction and venue shall be proper in such Courts and Carrier waives any claim or defense that such Courts will be an inconvenient forum. 9.2 Remedies. In addition to any other remedies that may be available to HAUL ALOT LOGISTICS at law or in equity, all provisions of these Terms and Conditions may be specifically enforced, however, the failure of HAUL ALOT LOGISTICS to promptly enforce such provisions shall not be construed to be a waiver of HAUL ALOT LOGISTICS’s rights hereunder. In addition, Customer recognizes that the payment of damages hereunder may not fully compensate HAUL ALOT LOGISTICS for Customer’s breach of the provisions of these Terms and Conditions and that HAUL ALOT LOGISTICS will likely suffer irreparable harm from such a breach. Accordingly, Customer agrees that should it breach, violate, or threaten to breach or violate the provisions of these Terms and Conditions, that HAUL ALOT LOGISTICS will be entitled to injunctive relief prohibiting Customer’s breach, violation or continued breach or violation without the need of HAUL ALOT LOGISTICS having to post any bond in connection with such injunctive relief. If the shipper/consignor, consignee, Haul Alot Logistics customer or other person or entity pursues a claim for cargo loss, theft, shortage, damage or delay involving a shipment tendered to Carrier hereunder directly against Carrier and prevails in pursuing recovery for such a claim, such party shall be entitled to recover from Carrier its costs and attorney fees incurred in pursuing such action. 9.3 Miscellaneous. These Terms and Conditions and any Load Confirmations issued to Customer by HAUL ALOT LOGISTICS pertaining to a load for freight offered, referred or tendered to HAUL ALOT LOGISTICS constitute the entire agreement between the HAUL ALOT LOGISTICS and Customer pertaining to HAUL ALOT LOGISTICS’s arranging for the transportation of Customer’s freight and are intended to be a complete integration of terms and cannot be altered, except through a written agreement signed by the President of HAUL ALOT LOGISTICS. No other prior or contemporaneous agreements exist between HAUL ALOT LOGISTICS and Customer, except as set forth in these Terms and Conditions. If any term or provision hereof is held invalid or unenforceable by a court or tribunal of competent jurisdiction, such term or provision shall be deemed to be modified to be enforceable or, alternatively, shall be deemed to be severed here from, and shall not affect the remaining provisions hereof, which shall remain enforceable to the full extent allowed by law. The failure of either party to enforce a breach or waiver of any term, condition or provision hereof shall not be deemed to constitute a waiver of any subsequent failure or breach. These Terms and Conditions shall be binding upon and inure to the benefit of any successors and assigns of HAUL ALOT LOGISTICS and/or Customer.
